Adverse Effects Reporting [FIFRA § 6(a)(2)]

Section 6(a)(2) of the Federal Insecticide Fungicide & Rodenticide Act (FIFRA) requires pesticide registrants and their agents to notify the U.S. Environmental Protection Agency (EPA) of additional factual information regarding unreasonable adverse effects on human health or the environment from the use of a registered pesticide. Dow AgroSciences is committed to complying with this requirement.

EPA considers agents of Dow AgroSciences to include not only employees, but others such as consultants, contract researchers, contract manufacturers, sub-registrants, retailers and supplemental distributors. Anyone who is acting on behalf of Dow AgroSciences and who may receive information about the effects of a product of Dow AgroSciences is responsible for complying with the adverse effects reporting requirements by notifying Dow AgroSciences.

Reporting Requirements
To fulfill the obligations of FIFRA § 6(a)(2), you must bring the following types of information to the immediate attention of the registrant:

  • Adverse Effects Incidents
  • Dietary or Environmental Pesticide Residue Incidents
  • Dietary or Environmental Residue Studies
  • Efficacy Studies
  • Epidemiological Studies
  • Failure of Performance Incidents
  • Toxicological Studies (complete or incomplete)

NOTE: The information may be reportable to the Environmental Protection Agency (EPA) even if it consists of unsubstantiated allegations. It is important that you act promptly because the reporting time frame is very short (as few as 15 days) and starts when the registrant or any agent of the registrant (e.g. employees, suppliers, distributors, sub-registrants) becomes aware of the information.

Reporting Forms
Immediately report any adverse effects information to the company that registered the product.
