Mycogen Seeds reserves the right to substitute product in the event of crop or allocation shortages. The buyer may accept or reject the substitute product at the point of offer. Mycogen Seeds shall not be liable for any breach of warranty or breach of contract claims in connection with unavailable product, and the Mycogen Seeds standard warranty and limitation of liability shall have full force and effect.

Mycogen Seeds warrants that the seed sold by it conforms to the descriptions on accompanying labels within tolerances established or permitted by law. THIS EXPRESS WARRANTY EXCLUDES AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WHICH ARE HEREBY DISCLAIMED. Because of the contamination factors that are beyond Mycogen Seeds� control, Mycogen Seeds cannot warrant or represent that Mycogen Seeds� products are free of genetically modified organisms.
